Key takeaways
- There is no single gym licence in India: a gym needs a set of separate state, municipal and central registrations.
- Shops and Establishments registration (or, in Haryana, an online intimation for smaller units) and a municipal trade licence are the usual starting points.
- GST, fire NOC, FSSAI and music licences depend on your turnover, building, counter sales and the music you play.
- Apply only on official portals, keep copies of every certificate, and confirm the details with the issuing office or a professional.
Is there a single gym licence in India?
No. India has no single "gym licence". A new gym usually needs Shops and Establishments registration (state labour department), a municipal trade licence (local municipal body), GST registration above the turnover limit (GST department), a fire NOC where the building needs one (state fire service), FSSAI registration if it sells supplements (FSSAI) and, optionally, Udyam registration (MSME ministry).
People search for a "gym license", "gym license requirements" or a "gym license application form", but each item below has its own law, office and online form. The exact list depends on your state, city, building, staff count and what you sell at the counter. This guide uses Haryana and Delhi as examples and links only to official portals. It is general information, not legal advice.
| Registration | Issued by | When it is needed |
|---|---|---|
| Shops and Establishments registration or intimation | State labour department | When you start the business; Haryana rules depend on worker count |
| Municipal trade or health trade licence | Municipal corporation or council | Before opening, where your city lists gyms as a licensed trade |
| GST registration | GST department, through the GST portal | When aggregate turnover crosses the legal limit; voluntary earlier |
| Fire NOC or fire safety certificate | State fire service | Depends on building height, floor area and occupancy class |
| FSSAI registration or licence | Food safety authority, through FoSCoS | If you sell supplements, shakes, packaged food or drinks |
| Music public-performance licence | Rights owners or bodies such as PPL India and IPRS | If you play recorded music for members |
| Udyam registration | Ministry of MSME | Optional, for MSME schemes and recognition |
| EPF and ESI registration | EPFO and ESIC | Once your staff make you coverable; check with each body |
| Building sanction and occupation certificate | Town planning or development authority (usually held by the owner) | Check before you sign the lease |
How does Shops and Establishments registration work in Haryana and Delhi?
Every state has its own shops law, and both Haryana and Delhi now handle it online. A gym is a commercial establishment, so this is usually the first registration an owner completes.
Haryana: the Haryana Shops and Commercial Establishments Act, 1958 was amended by an ordinance of November 2025, later passed as an amendment Act. As summarised in EY’s alert on the amendment, the Act now applies to establishments with 20 or more workers, which register online within a month of starting. Smaller establishments file an online intimation instead. Use the Labour Department’s e-services at hrylabour.gov.in, and check there which form applies to your headcount.
Delhi: registration under the Delhi Shops and Establishments Act, 1954 is done on the Labour Department’s online registration portal. Under the 2021 amendment rules, the occupier applies online within 90 days of starting work, and the certificate is generated online. A December 2025 amendment, as reported, removed the renewal requirement. A company newly incorporated in Delhi takes this registration through the MCA’s SPICE+ forms, as the portal notes.
Does a gym need a municipal trade licence, and is the building cleared?
Usually yes: most cities require a trade licence from the municipal body, and that licence depends on the premises being in a permitted location. This is the item people mean when they search for a "gym license in Delhi".
- Delhi: the MCD issues health trade licences online on its health trade licence portal. Many guides place gyms in this category; confirm the category for your trade with your MCD zone before applying. When the MCD launched instant licences in June 2025, it said licences generated for trades in non-conforming areas would be treated as void from the outset.
- Haryana: municipal corporations and councils issue trade licences through the Urban Local Bodies department’s online services at ulbharyana.gov.in. Ask your municipal office whether gyms are a listed trade in your town.
- Building use: before signing a lease, ask the owner for the building sanction and occupation certificate, and check that a gym is a permitted use on that floor. A basement or residential plot can be a problem even if the rent is attractive.
Keep the name and address identical on every certificate, the lease and your Google Business Profile. Mismatches slow down approvals and verification.
When does a gym need GST registration?
A gym must register for GST when its aggregate turnover in a financial year crosses the limit in Section 22 of the CGST Act, and it may register voluntarily before that. The limit is set in the law, with a lower limit for special-category states; Haryana and Delhi are not special-category states.
Read the threshold in Section 22 on CBIC’s tax information portal. Aggregate turnover counts all your supplies under one PAN, so membership fees, personal training and counter sales of supplements are added together. Apply on the official GST portal; the application is filed online in Form GST REG-01. For the rate on memberships and the input tax credit question, see our guide to GST on gym membership.
Do you need a fire NOC for a gym?
It depends on the building, not on the word "gym": state fire rules decide by height, floor area and occupancy class whether a fire safety certificate is needed. In many buildings the owner or the whole building holds the certificate, and your fit-out must not break it.
Haryana’s law is the Haryana Fire and Emergency Services Act, 2022. In December 2025 the state notified rules under which fire safety certificates are issued and renewed online after an inspection report by an empanelled agency. Delhi follows the Delhi Fire Service Rules, 2010, which were amended in 2025. Ask your local fire station which category your floor falls in.
- Ask the owner whether the building has a valid fire safety certificate and whether a gym on your floor is covered.
- Keep exits and staircases free of equipment and stacked plates.
- Do not block sprinklers or hydrants with mirrors, partitions or false ceilings.
- Plan a heavy cardio row and extra air-conditioning load with a qualified electrician.
Do supplements, music or Udyam need separate registrations?
Yes, each is separate: FSSAI covers food you sell, music licences cover recorded music you play, and Udyam is an optional MSME registration.
- FSSAI: selling protein, pre-workout, shakes, bars or bottled drinks makes you a food business. Apply on FoSCoS, which offers basic registration (Form A) or a licence (Form B) depending on your kind of business and turnover; check FoSCoS’s eligibility sheet before choosing.
- Music: playing recorded music to members can be a public performance under the Copyright Act, 1957. Organisations such as PPL India and IPRS issue licences to businesses, including gyms. Ask them what your use needs and take legal advice if unsure.
- Udyam: the official Udyam portal says registration is free, paperless and based on self-declaration with Aadhaar, with PAN and GSTIN (where applicable) linked automatically. It warns that no other website is official, and no renewal is needed.
- Staff: once you hire trainers and front-desk staff, check EPF and ESI coverage with EPFO and ESIC.
How do you apply online, step by step?
Work in this order, because later applications ask for documents from earlier ones. There is no single gym licence application form; each portal has its own.
- Check the building: sanction, occupation certificate, permitted use and the fire safety position, before you sign the lease.
- Keep PAN, Aadhaar, the rent agreement, a recent utility bill and photos of the premises ready as clear scans.
- File Shops and Establishments registration or intimation on your state labour portal.
- Apply for the municipal trade or health trade licence on your city’s portal.
- Register for GST if your turnover requires it, or if you choose to register voluntarily.
- Apply for FSSAI registration before you put supplements on the counter.
- Sort out music licences before opening day, and add Udyam if you want MSME recognition.
- Save every certificate as a PDF, note renewal dates and display certificates where the rules require.
Search for portals by their official .gov.in or .nic.in address, not ads. If you use a consultant, ask them to file on the official portal in your name and share the login.
How DVM Techno Can Help
DVM Techno does not file registrations, but we build what a gym runs on once it is registered. Balvira, the gym management software built by DVM Techno, takes UPI, card and cash fees with GST invoices, and a gym without a GSTIN gets a receipt that says so. For a site that shows your registered name, address and timings, see our gym website design page.
Frequently Asked Questions
Is there a gym licence in India?
No single gym licence exists in India. A gym usually needs Shops and Establishments registration from the state labour department, a municipal trade licence, GST registration once turnover crosses the legal limit, a fire NOC if the building requires one, and FSSAI registration if it sells supplements or drinks. Music licences and Udyam registration may also apply. Requirements vary by state and city, so confirm locally.
How do I get a gym licence in Delhi?
In Delhi, register under the Delhi Shops and Establishments Act on the Labour Department’s online portal within 90 days of starting, and apply to the MCD for a trade licence on its health trade licence portal after confirming your category with your zone. Check that the premises are in a conforming area, then handle GST, fire safety and FSSAI as they apply.
Can I apply for a gym licence online?
Yes, each registration has an official online route. Haryana’s Labour Department uses hrylabour.gov.in, Delhi uses labourcis.nic.in, the MCD has a health trade licence portal, Haryana’s municipal bodies use ulbharyana.gov.in, GST uses gst.gov.in, FSSAI uses FoSCoS and Udyam has its own portal. Avoid look-alike sites, and keep the logins in the owner’s name.
Does a small gym need GST registration?
A gym must register for GST when its aggregate turnover in a financial year crosses the limit in Section 22 of the CGST Act. Membership fees, personal training and counter sales under the same PAN are counted together. A gym below the limit may still register voluntarily, for example to work with corporate clients. Check the current limit and your figures with a tax professional.
Do I need FSSAI registration to sell protein supplements in my gym?
Yes. Selling protein powders, shakes, bars or bottled drinks makes the gym a food business under FSSAI rules. Apply on the FoSCoS portal, where smaller businesses usually take basic registration in Form A and larger ones a state or central licence in Form B. Which one applies depends on your kind of business and turnover, so check FoSCoS’s eligibility sheet first.
